US v. Griffin, 05-4177
Conviction for robbery, conspiracy, and using, possessing, and brandishing or discharging a firearm is affirmed where one defendant's participation in a single robbery along with his travel to scout other targets and willingness to participate in additional robberies provided sufficient evidence to support his conspiracy conviction. Sentence for another defendant is remanded where the district court attached a presumption of reasonableness to a within-Guidelines sentence, and the record did not reflect that defendant would have received the same sentence absent that presumption.
