Chicago Dist. Council of Carpenters Pension Fund v. Reinke Insulation Co., 05-3555
Summary judgment for Union and its pension fund on defendant's counterclaims in a suit involving alleged deficiencies in defendant's contributions to Union's pension and welfare funds is affirmed where: 1) there was insufficient evidence for a defamation claim to allow a finder of fact to conclude the Union acted with actual malice; 2) the Labor Management Relations Act preempted state law claims; 3) defendant could not show that the Union picketed in order to force defendant to rejoin a multi-employer bargaining association; and 4) defendant could not show actual malice to prevail in a claim under the Illinois Uniform Deceptive Trade Practices Act.
