Thanongsinh v. Bd. of Educ., 05-3002

Summary judgment for defendants in a suit claiming violation of both Title VII and 42 U.S.C. section 1981(a) is affirmed where the Title VII claim against an individual in his official capacity was redundant, but reversed where the plaintiff created a genuine issue of material fact regarding: 1) his qualification for the position; 2) the differential treatment of similarly situated individuals; 3) pretextual reasons for his demotion; and 4) discriminatory motivations for interfering with his employment contract.
