FTC v. Ross, 12-2340

Judgment enjoining defendant from participating in the accused deceptive internet advertising practices and holding her jointly and severally liable for equitable monetary consumer redress is affirmed, where: 1) under the Federal Trade Commission Act (FTCA), the district court had sufficient statutory power to award "complete relief," including monetary consumer redress, which is a form of equitable relief; 2) one may be found individually liable under the FTCA if she participated directly in the deceptive practices or had authority to control those practices, and had or should have had knowledge of the deceptive practices; 3) there is no reversible error in the district court’s evidentiary rulings; and 4) the district court did not err in its findings that defendant had "control" of the company, participated in any deceptive acts, and had knowledge of the deceptive advertisements.
