US v. Oceanpro Industries, Ltd., 10-5239

In a prosecution of a seafood wholesaler and two of its employees for purchasing untagged and oversized striped bass in violation of the Lacey Act, and of the wholesaler and one of its employees for giving a false statement to federal law enforcement officers during the course of the investigation of the crimes, convictions and a restitution order are affirmed, where: 1) venue for the false statement charge was proper in the District of Maryland even though the statement was made in Washington, DC, since its prescribed effects would be felt in Maryland; and 2) the restitution award was proper because, under applicable statutory provisions, the district court was authorized to require the defendants to make restitution to "victims," and the states of Maryland and Virginia qualified as such.
