National Labor Relations Bd. v. Interbake Foods, LLC, 09-2245
In an administrative hearing before the National Labor Relations Board where a party challenges the authority of an administrative law judge (ALJ) to issue an order requiring production of documents, a district court's authority to review the order is affirmed because an ALJ’s order imposed in the course of an administrative hearing, even when ruling on evidence, can only be enforced by an Article III court.
