US v. Simmons, 08-4475
On remand from the U.S. Supreme Court, the use of sentence enhancement under 21 U.S.C. section 841(b)(1)(D) for convictions of multiple marijuana-related crimes is affirmed even in light of the recent decision in Carachuri-Rosendo v. Holder, 560 U.S. ___, 130 S. Ct. 2577 (2010).
