Benham v. City of Charlotte, 10-1132
In a 42 U.S.C. section 1983 action seeking injunctive relief and damages from the City of Charlotte and two of its officials, alleging that two Charlotte ordinances related to public assembly contravene the Free Speech Clause of the First Amendment and the Equal Protection Clause of the Fourteenth Amendment, grant of summary judgment to defendants is affirmed where the plaintiffs are unable to sustain their burden of demonstrating that they suffered a cognizable injury.
