US v. Midgett, 05-5263

Convictions and sentences for malicious damage to property used in interstate commerce resulting in personal injury and bank robbery related crimes are affirmed except as to the imposition of separate sentences on the bank robbery and putting life in jeopardy counts, which requires vacation of the bank robbery sentence as it is a lesser included offense of the other count.
