Victaulic Co. v. Tieman, 07-2088

In a dispute centering on a whether a covenant not to compete between an employer and former employee is unreasonable, a decision dismissing the employer's claims is vacated and remanded as: 1) the appellate jurisdiction existed in the case; and 2) because the reasonableness of the covenant not to compete is a fact-intensive inquiry, it should not have been determined on the pleadings.
