An appeal by the government from an allegedly erroneous pre-trial oral ruling, in which a district court explained how it intended to instruct a jury with respect to the crime of attempted evasion of payment of a tax, is dismissed where the circuit court lacked jurisdiction and a writ of mandamus was not appropriate.
