United States Second Circuit

Galloway v. Town of Greece, 10-3635

In a suit asserting that aspects of a town's practice of beginning town board meetings with a prayer violated the Establishment Clause, summary judgment to the defendant town is reversed, where on the totality of the circumstances, the town's prayer practice was an endorsement of a particular religious viewpoint, given the prayer-giver selection process, the content of the prayers, and the contextual actions and inactions of prayer-givers and town officials.
