Almeida-Amaral v. Gonzales, 04-5841

Petition challenging denial of motion to suppress evidence of removability is denied where petitioner cannot establish, on the facts of this case, that the arresting agent committed an egregious violation of a constitutional right, and because the relevant regulations do not prohibit agents from taking statements from an unaccompanied 17-year old.
