Swaby v. Yates, 16-1821
In a petition brought by a citizen of Jamaica for review of a decision of the Board of Immigration Appeals (BIA) affirming his order of removal and denying his request for cancellation of removal, the petition is dismissed in part and denied in part where: 1) pettioner's convictions clearly do relate to a controlled substance as defined in the federal drug schedules, as 8 U.S.C. section 1227(a)(2)(B)(i) requires, thus the BIA's correctly determined that petitioner had committed a removable offense; and 2) there was no legal error because the IJ correctly weighed the positive factors against the negative factors when denying petitioner's request for cancellation of removal.
