Nolan v. CN8, 10-2239

In an appeal from the grant of summary judgment against plaintiff in his wrongful termination action alleging speech-motivated retaliation, Mass. Gen. Laws Ann. ch. 12, sections 11H, 11I, judgment is affirmed where there are no genuine issues of material fact as to whether plaintiff was insubordinate, breached his employment agreement, and publicly acted contrary to defendant's business interests when, in a not-so-pithy email, he publicly castigated the selection of Bill O'Reilly for the prestigious Governor's Award.
