United States First Circuit

Glik v. Cunniffe, 10-1764

In an interlocutory appeal from a judgment of the district court denying defendant-police officers qualified immunity from a Section 1983 action alleging that defendants violated plaintiff's rights by arresting him for filming the public arrest of a young man, judgment is affirmed where on the facts alleged, plaintiff was exercising a clearly-established First Amendment right and his Fourth Amendment rights were violated by his arrest without probable cause.
