San Geronimo Caribe Project v. Acevedo-Vila, 09-2566
In a Section 1983 action arising from the administrative suspension of construction permits for plaintiff's project following a government opinion that the construction lands were part of the public domain, judgment of the district court dismissing action on the grounds of Rules 12(b)(1) and 12(b)(6) is affirmed where although the district court's judgement on plaintiff's procedural due process claim was erroneous, defendants are entitled to qualified immunity.
