Shamus Holdings LLC v. LBM Financial, LLC, 10-2216
In a bankruptcy dispute involving the effect of a state bankruptcy limitations statute on the automatic stay provisions of the Bankruptcy Code, judgment of the district court is affirmed because 11 U.S.C. section 108(c) tolls the limitations period set by the Massachusetts Obsolete Mortgages Statute, thereby enlarging the time within which creditor can bring a judicial foreclosure action until after the termination or expiration of the automatic stay.
