United States First Circuit
US v. Barnes, 06-2268
Conviction and sentence for drug violations are affirmed over defendant's arguments that: 1) the district court erred in concluding that the affidavit submitted in support of a search warrant demonstrated probable cause; 2) the evidence was insufficient to sustain his conviction; and 3) the district court erred by relying on a prior conviction not proven to the jury beyond a reasonable doubt in imposing his sentence.
