RUSSELL v. N. BROWARD HOSP., 02-13343

For purposes of the Family and Medical Leave Act and 29 C.F.R. section 825.114, a Department of Labor regulation adopted to provide an objective definition for the terms "serious health condition" and "continuing treatment," "more than three consecutive calendar days" of incapacity means a period of continuous incapacity extending more than 72 hours. This regulatory definition is not invalid.
