FED. DEPOSIT INS. CO. v. SCHUCHMANN, 01-2003

An award of attorney fees and costs, under the bad faith exception to the "American Rule" pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. section 2412(b), is reversed where the district court's conclusory finding of bad faith or improper motive amounted to an abuse of discretion.
