SUBHASH C. BATRA, M.D., APPELLANT v. COVENANT HEALTH SYSTEM D/B/A COVENANT MEDICAL CENTER/COVENANT MEDICAL CENTER-LAKESIDE, APPELLEE
ORDER ON UNOPPOSED MOTION TO ACCESS SEALED RECORDS
Pending before the court is Appellee Covenant Health System, d/b/a Covenant Medical Center/Covenant Medical Center-Lakeside's Motion to Access Confidential/Sealed Records. On December 13, 2017, the trial court sealed documents contained in volumes two, three, and four of the clerk's record and volume one of the first supplemental clerk's record. Those volumes of the clerk's record and first supplemental clerk's record were filed under seal with the clerk of this court. Appellee now seeks access to the sealed portion of the clerk's record for the purpose of this appeal. We grant Appellee's unopposed motion.
Accordingly, we order the sealed volumes of the clerk's record and the first supplemental clerk's record to be made available to the attorneys of record for the purpose of preparing briefs and motions in this appeal. The clerk of this court shall make the sealed record available through the Attorney Portal (https://attorneyportal.txcourts.gov) in a format that is accessible only to the attorneys of record. Appellate counsel may review the contents of the sealed record but may not print or copy any of its contents. The parties and their counsel are ordered not to disclose or disseminate any information contained in the sealed record to any other person or entity. Should the parties address any arguments related to evidence contained in the sealed record, the parties are ordered to note on the cover page of their respective briefs the following: “SEALED BY ORDER OF THE COURT.” The clerk shall remove access to the sealed record from the Attorney Portal after submission of the appeal to the court.
It is so ordered.
