IN RE: PROGRESSIVE COUNTY MUTUAL INSURANCE COMPANY, Relator

No. 05-10-00094-CV

Decided: January 27, 2010

Before Justices Morris, Francis, and Fillmore

MEMORANDUM OPINION

Opinion by Justice Fillmore

Relator contends the trial court erred in denying its motion for severance and abatement and in ordering certain discovery.   The facts and issues are well known to the parties, so we need not recount them herein.   Based on the record before us, we conclude relator has not shown it is entitled to the relief requested.   See Tex.R.App. P. 52.3(j), 52.8(a);  Walker v. Packer, 827 S.W.2d 833, 837 (Tex.1992).   Accordingly, we DENY relator's petition for writ of mandamus.   Relator's request for emergency temporary relief is MOOT.
