Sause v. Bauer, 17-742

Reversed and remanded. Plaintiff alleges that when police officers visited her apartment in response to a noise complaint, they engaged in strange and abusive behavior before citing her for disorderly conduct and interfering with law enforcement. Plaintiff also claims that the police told her to stop when she got on her knees and began praying. Plaintiff filed a complaint alleging violations of her First and Fourth Amendment rights. The District Court dismissed the complaint for failure to state a claim and the Tenth Circuit affirmed. The Supreme Court held that there is not enough information in the record to determine if there were violations of the First and Fourth Amendments and therefore reversed and remanded.
