Ortiz v. US, 16-1423

Affirmed. Oritiz, a US Air Force Airmen First Class, was convicted by court-martial of possession and distributing child pornography. He now petitions the US Supreme Court for a review of the Court of Appeals for the Armed Forces (CAAF) decision, which Oritz claims was tainted by the Judge’s appointment on two military review panels. The US Supreme Court ruled that it had jurisdiction to review CAAF decisions based on Marbury v. Madison, 1 Cranch 137. Further, the court found that the appointment of the judge on two military panels did not violate the Appointments Clause or 10 USC section 973(b)(2)(A). Therefore, the judgment of the CAAF was affirmed.
