Pereira v Sessions, 17-459

Reversed and remanded. Under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 non-permanent residents are subject to removal under certain circumstances. Plaintiff, a native of Brazil, came to the US in 2000 and remained after his visa expired. He was stopped for a DUI and was sent a notice to appear by the Department of Homeland Security. The notice did not contain a date or time for the removal hearing. The plaintiff failed to appear and DHS ordered his removal. The Supreme Court ruled that the Government must furnish the time and place information in order to enforce the removal.
