Town of Chester v. Laroe Estates, Inc., 16-605

In a land development dispute brought by a developer-plaintiff against a Town, claiming that the Town had obstructed his plans for a subdivision and asserting a regulatory takings claim under the Fifth and Fourteenth Amendments, the Second Circuit's judgment reversing the District Court's denial of a motion to intervene filed by a real estate development company holding an equitable interest in the subdivision, is vacated where a litigant seeking to intervene as of right under Rule 24(a)(2) must meet the requirements of Article III standing if the intervenor wishes to pursue relief not requested by a plaintiff.
