County of Los Angeles v. Mendez, 16-369

In a suit under 42 U.S.C. section 1983, brought by plaintiffs who were injured by deputies during the execution of a search warrant, alleging Fourth Amendment claims, including a warrantless entry claim, a knock-and-announce claim, and an excessive force claim, the Ninth Circuit Court of Appeals' decision affirming the District Court's judgment holding defendants liable on the excessive force claim under the Ninth Circuit's provocation rule, is vacated and remanded where the Fourth Amendment provides no basis for the Ninth Circuit's 'provocation rule.'
