Buck v. Davis, 15-8049

In a petition for writ of habeas corpus relief from a death sentence for conviction of murder on grounds of a violation of petitioner's Sixth Amendment right to the effective assistance of counsel, due to counsel's introduction of expert testimony evidence that petitioner's race played a statistical factor in his likelihood to commit acts of violence in the future, the Fifth Circuit's denial of petitioner's Rule 60(b)(6) motion for a certificate of appealability (COA) is reversed where: 1) the Fifth Circuit exceeded the limited scope of the COA analysis; 2) petitioner has demonstrated ineffective assistance of counsel under Strickland v. Washington, 466 U. S. 668; and 3) the district court's denial of petitioner's Rule 60(b)(6) motion was an abuse of discretion.
