United States Supreme Court

Utah v. Strieff, 14-1373

In a case in which a criminal defendant was detained, determined to have an outstanding warrant, then searched, the Utah Supreme Court's judgment suppressing the evidence is reversed where: 1) the evidence seized incident to defendant's arrest is admissible based on an application of the attenuation factors from Brown v. Illinois, 422 U. S. 590; 2) there was no flagrant police misconduct; and 3) the officer's discovery of a valid, pre-existing, and untainted arrest warrant attenuated the connection between the unconstitutional investigatory stop and the evidence seized incident to a lawful arrest.
