United States Supreme Court
Simmons v. Himmelreich, 15-109
In a case in which a federal prisoner filed two suits against the U.S. and individual Bureau of Prison employees, under the Federal Tort Claims Act (FTCA) and a constitutional tort theory, respectively, alleging that a severe beating he received from a fellow inmate was the result of negligence by prison officials, the Sixth Circuit's reversal of the District Court's grant of summary judgment to defendants in the second suit, on grounds that the second suit was foreclosed by the FTCA's judgment bar provision, which served as the basis for dismissal of the first suit, is affirmed where the judgment bar provision does not apply to the claims dismissed for falling within the 'Exceptions' section of the FTCA.
