Kernan v. Hinojas, 15-833
In a federal habeas corpus petition action, the Ninth Circuit's judgment that this case decided that the Supreme Court of California's summary denial of a habeas petition was not 'on the merits,' and therefore AEDPA's deferential-review provisions did not apply under 28 U.S.C. section 2254(d), is reversed where, containing no statement to the contrary, the Supreme Court of California's summary denial of the petition was therefore on the merits and accordingly, the Ninth Circuit should have reviewed petitioner's ex post facto claim through AEDPA's deferential lens.
