Sheriff v. Gillie, 15-338

In a case alleging violations of the Fair Debt Collection Practices Act (FDCPA),15 U.S.C. section 1692(a)-(d), when defendant "special counsel" law firm sent debt collection letters on the Attorney General's letterhead, the Sixth Circuit's vacation of the District Court's grant of summary judgment to defendant, holding that special counsel are "officers" of the State and, in any event, their use of the Attorney General's letterhead is not false or misleading, is reversed where, assuming, arguendo, that special counsel do not rank as "state officers" within the meaning of the FDCPA, petitioners' use of the Attorney General's letterhead, nevertheless, does not offend section 1692e.
