Bank Markazi v. Peterson, 14-770

In consolidated cases brought by 1,000 victims of Iran-sponsored acts of terrorism, their estate representatives, and surviving family members seeking to obtain assets held in a New York bank account owned by the Central Bank of Iran, the Second Circuit's decision that 22 U.S.C. section 8772 -- which requires a court, before allowing execution against these assets, to determine whether Iran holds equitable title to, or the beneficial interest in, the assets -- permissibly changed the law applicable in a pending litigation, is affirmed where Section 8772 does not violate the separation of powers.
