Horne v. Dep't of Agriculture, 14-275
In a suit brought by raisin growers against the Department of Agriculture, alleging that the Raisin Administrative Committee's imposition of a reserve requirement that growers set aside a certain percentage of their crop for the account of the Government, free of charge, was an unconstitutional taking of their property under the Fifth Amendment, the Ninth Circuit's judgment that the reserve requirement was not a Fifth Amendment taking is reversed where the Fifth Amendment requires that the Government pay just compensation when it takes personal property, just as when it takes real property.
