McFadden v. US, 14-378
Conviction for distributing "bath salts," a controlled substance analogue, in violation of the federal Controlled Substance Analogue Enforcement Act of 1986 (Analogue Act), is vacated and the Fourth Circuit's judgment reversed, because when a controlled substance is an analogue, 21 U.S.C. section 802(a)(1) requires the Government to establish that the defendant knew he was dealing with a substance regulated under the Controlled Substances Act or Analogue Act.
