United States Supreme Court

Brumfield v. Cain, 13-1433

In a case involving a claim of intellectual disability as articulated in Atkins v. Virginia. 536 U.S. 304, within the context of a state death row prisoner's petition for federal habeas corpus relief, the Fifth Circuit's denial of relief is reversed where petitioner satisfied 28 U.S.C. section 2254(d)'s requirements and is therefore entitled to have his Atkins claim considered on the merits in federal court.
