Tibble v. Edison Int'l, 13-550
In an ERISA action alleging breach of fiduciary duty connected with the addition of certain mutual funds to a 401(k) plan, the Ninth Circuit Court of Appeals decision, that the complaint was barred by the 6-year statute of limitations in 29 U. S. C. section 1113, is reversed where the Ninth Circuit erred by applying section 1113's statutory bar to a breach of fiduciary duty claim based on the initial selection of the investments without considering the contours of the alleged breach of fiduciary duty.
