In suits under the Federal Tort Claims Act (FCTA), the time limits of 28 U.S.C. section 2401(b) are subject to equitable tolling, and the Ninth Circuit's judgment is affirmed where the Government's arguments for treating section 2401(b)'s time limits as jurisdictional and not subject to equitable tolling are unpersuasive.
