United States Supreme Court
Riley v. California, 13-132
The police generally may not, without a warrant, search digital information on a cell phone seized from an individual who has been arrested. Additionally, although the search incident to arrest exception to the warrant requirement does not apply to cell phones, the continued availability of other case-specific exceptions, including the exigent circumstances exception, may still justify a warrantless search of a particular phone.
