American Broadcasting Cos. v. Aereo, Inc., 13-461
The Second Circuit Court of Appeals' holding that defendant does not infringe plaintiffs' copyrights by selling its subscribers a technologically complex service that allows them to watch television programs over the Internet at about the same time as the programs are broadcast over the air is reversed and remanded, where: 1) the Copyright Act of 1976 gives a copyright owner the "exclusive right" to "perform the copyrighted work publicly"; 2) defendant is not just an equipment supplier; 3) defendant performs plaintiffs' works publicly within the meaning of the Transmit Clause of the Copyright Act; and thus, 4) defendant infringes this exclusive right.
