Martinez v. Illinois, 13-5967

The Double Jeopardy Clause bars the State's attempt to appeal in the hope of subjecting defendant to a new trial on charges of aggravated battery and mob action, where: 1) on the day defendant's trial was set to begin, the State declined to present any evidence because it wanted the trial court to grant a continuance, and the trial court granted defendant's motion for a directed not-guilty verdict; 2) defendant was subjected to jeopardy because the jury was impaneled and sworn; and 3) the trial court found the State's evidence insufficient to sustain a conviction, so there is no doubt that defendant may not be retried.
