Koontz v. St. Johns River Water Management District, 11-1447
In a dispute involving plaintiff's attempt to obtain permits from defendant to develop a section of his property, defendant's denial of plaintiff's proposal to mitigate the environmental impacts of the same, and defendant's demands in order to approve his request, the Florida Supreme Court's judgment for defendant is reversed and remanded, where: 1) the government's demand for property from a land-use permit applicant must satisfy the Nollan/Dolan requirements even when it denies the permit; and 2) the government's demand for property from a land-use permit applicant must satisfy the Nollan/Dolan requirements even when its demand is for money.
