Tarrant Regional Water District v. Herrmann, 11-889
The Red River Compact, a congressionally sanctioned agreement that allocates water rights within the Red River basin among the States of Oklahoma, Texas, Arkansas, and Louisiana, does not pre-empt Oklahoma water statutes that restrict out-of-state diversions of water, because the Compact creates no cross-border rights in its signatories for these statutes to infringe, and the Oklahoma water statutes also do not run afoul of the Commerce Clause.
