Missouri v. McNeely, 11-1425
Judgment finding that the nonconsensual warrantless blood test violated defendant's Fourth Amendment right to be free from warrantless searches of his person, and suppressing said evidence, is affirmed, where, in drunk driving investigations the natural dissipation of alcohol in the bloodstream does not constitute an exigency in every case sufficient to justify conducting a blood test without a warrant.
