US v. Alvarez, 11-210
In a case involving a conviction under the Stolen Valor Act, which makes it a crime to falsely claim receipt of military decorations or medals and provides an enhanced penalty if the Congressional Medal of Honor is involved, 18 U.S.C. sections 704(b), (c), the Ninth Circuit's decision reversing the conviction and finding the Stolen Valor Act invalid under the First Amendment is affirmed where the Act infringes upon speech protected by the First Amendment.
