In an appeal from a judgment of the appeals court upholding the trial court's dismissal of petitioner's AEDPA petition for habeas relief as time-barred, judgment is affirmed where 28 U.S.C. section 2253(c)(3) is a mandatory but nonjurisdictional rule and because, for purposes of Section 2244(d)(1)(A), judgment becomes final on the date that the time for seeking such review expires.
