DePierre v. US, 09-1533

In a dispute involving the proper application of the Anti-Drug Abuse Act of 1986, 21 U.S.C. section 841(b)(1)(A), judgment of the appeals court upholding the conviction of petitioner for distribution of 50 grams or more of cocaine base under sections 841(a)(1) and (b)(1)(A)(iii) is affirmed where cocaine base, as used in section 841(b)(1), means not just crack cocaine, but cocaine in its chemically basic form.
