Virginia Office for Protection and Advocacy v. Stewart, 09-529
In a dispute arising from a petition for federal injunctive relief against state officers under the Developmental Disabilities Assistance and Bill of Rights Act and the Protection and Advocacy for Individuals with Mental Illness Act , judgment of the appeals court that defendants are immune from suit under the Eleventh Amendment is reversed because Ex parte Young allows a federal court to hear a lawsuit for prospective relief against state officials where the suit is brought by another agency of the same State.
