Because Congress recognizes the tribes' criminal jurisdiction over nonmember Indians, the Spirit Lake Tribe acted in its capacity as a sovereign authority when it prosecuted defendant, thus the Double Jeopardy Clause does not prohibit the Federal Government from prosecuting him for a discrete federal offense.
